Terms of service
Effective October 3, 2026
These terms cover IntakeBay, made by Smart Apps Lab LLC ("we", "us"). They apply to auto body shops that create an account ("shops", "you") and, in the last section, to people who check in at a shop ("customers"). By creating an account or using the service, you agree to them.
What we provide
IntakeBay is software that lets a shop take check-ins from its customers on a shop tablet, the customer's own phone, or the shop's website; collect photos and electronic signatures; and send repair updates by text. We provide the software. We are not a party to any agreement between a shop and its customers, and we don't give estimates, perform repairs, or stand behind a shop's work.
Your account
- You must be authorized to act for the shop you sign up, and the information you give us must be accurate.
- Keep passwords private. You're responsible for what happens under your account, including what your team members do and what happens on tablets you pair.
- Remove team members and revoke tablets you no longer use. Tell us right away at the address below if you think your account has been misused.
Your agreement text is yours
The repair authorization templates we offer, including the Texas template, are a starting point, not legal advice. You decide what your agreement says, including fees, your legal name and every clause, and you're responsible for making sure it's accurate and follows the laws that apply to your shop, including consumer protection, auto repair and electronic signature laws. Have your attorney review it before you publish it.
We keep every published version unchanged and record which version each customer signed, but we don't guarantee that any agreement or signature will be enforceable.
Customer information
- Your shop owns the information your customers give you. You allow us to store and process it to run the service for you, as described in our privacy policy.
- Use customer information only for your relationship with that customer, and follow the laws that apply to it.
- Don't use the service to collect information you don't need for a repair, such as card numbers or government ID numbers.
Text messages
- Texts go only to customers who choose "Yes, text me" during check-in, and to the notification number you set for your shop.
- Use texting for the customer's repair: status updates, pickup notices and answers to their questions. Don't use it for advertising or promotions.
- When a customer replies STOP, they won't receive more texts. Don't try to reach them by text another way through the service.
- We may pause texting for a shop if it's misused or if a phone carrier requires it. The SMS terms describe the program customers join.
Acceptable use
Don't use the service to:
- break the law, mislead customers, or pretend to be another business;
- send spam or messages people didn't agree to;
- upload anything harmful, or try to get into accounts, data or systems that aren't yours;
- copy, resell or reverse engineer the software, or overload it.
Fees and billing
Taking check-ins requires a subscription of $200 per month for your company, billed monthly through Stripe, our payment processor. That is a limited-time price; the regular price is $250 per month. You can set up your shop before you subscribe.
You can cancel anytime from Billing in the app's Settings. Your access continues to the end of the period you've paid for, and we don't give refunds for partial months. Phone carriers may charge your customers for messages under their own plans.
Availability and changes
We work to keep the service running and your data safe, but we can't promise it will never be interrupted. Features may change, especially during early access. Keep the records you need: you can export check-ins to CSV and download signed PDFs at any time.
Ending your account
You can stop using the service and ask us to delete your account at any time. We may suspend or close an account that breaks these terms or puts customers or the service at risk; where we can, we'll tell you first and give you a chance to export your data.
Disclaimers and limits
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim about the service is limited to the greater of the amount you paid us in the 12 months before the claim and $100.
You agree to defend and hold us harmless from claims that arise from your agreement text, your repairs, your use of customer information, or texts sent at your direction.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in Harris County, Texas.
If you're checking in at a shop
- Your repair agreement is between you and the shop. Questions about your estimate, repair, bill or vehicle go to the shop.
- Give accurate information, and sign only if you're the vehicle's owner or authorized by the owner.
- When you sign electronically, you agree that your electronic signature and initials are your signature for that agreement. You can ask the shop for a copy of what you signed.
- Texts are optional. See the SMS terms.
Changes to these terms
If we change these terms, we'll update the date at the top, and tell shops by email or in the app before significant changes take effect. Continuing to use the service after that means you accept the new terms.
